Terms and Conditions

1. Agreement to These Terms
By purchasing or participating in Landscape Design Coaching services offered by Garden Project Academy ("Garden Project Academy," "we," "us," or "our"), you ("Client") agree to be bound by these Terms and Conditions. Please read them carefully before booking or purchasing any coaching service. If you do not agree to these terms, please do not purchase or participate in these services.
2. Nature of Services: Educational Coaching Only
Landscape Design Coaching is an educational coaching service designed to teach and support you in learning how to plan and design your own landscape. This is not a professional landscape design, landscape architecture, or landscape contracting service.
You expressly understand and agree to the following:
• Garden Project Academy is providing educational coaching and instruction only. We are not acting as your landscape designer, landscape architect, or landscape contractor in any capacity.
• No professional landscape design will be created, provided, or delivered by Garden Project Academy on your behalf as part of these services.
• No contractor-client, designer-client, or architect-client relationship is formed between you and Garden Project Academy through these services.
• Any plans, sketches, layouts, or design concepts you develop during or as a result of coaching sessions are your own work product, created by you based on educational instruction.
• Garden Project Academy does not review, approve, certify, or warrant any plans or designs you create.
• You are solely responsible for all decisions regarding your landscape, including any plans you develop, contractors you hire, materials you purchase, and work performed on your property.
If you require professional landscape design services, landscape architecture, or contractor services, we encourage you to seek a licensed professional in your area.
3. Session Delivery
Landscape Design Coaching sessions are delivered via video call (such as Zoom or a similar platform). Sessions may be structured as single one-time sessions, multi-session packages, or other formats as offered at the time of purchase. The specific details of your session format will be outlined at the time of booking.
4. Client Responsibilities and Preparation
To make the most of your coaching sessions and to allow Garden Project Academy to provide effective educational guidance, you agree to come prepared to each session with the following materials, as applicable:
• Clear photographs of your landscape, garden space, or outdoor area
• Accurate measurements of your site or the areas you are working on
• Any other materials, worksheets, or information requested by Garden Project Academy in advance of your session
Garden Project Academy is not responsible for the quality or outcomes of a session where the Client arrives unprepared or without the requested materials. Sessions may proceed at a reduced scope or may need to be rescheduled (subject to the cancellation policy below) if required preparation materials are not available.
5. Cancellation, Rescheduling, and No-Show Policy
The following policy applies to all scheduled coaching sessions:
• Cancellations or rescheduling requests must be submitted at least 24 hours before the scheduled start time of your session.
• If you cancel or request to reschedule with less than 24 hours notice, or if you do not attend your scheduled session (a "no-show"), the session will be forfeited. No refund will be issued and no rescheduling will be offered for that session.
• To cancel or reschedule, please contact us at the email address provided at the time of booking.
Garden Project Academy reserves the right to cancel or reschedule a session due to illness, emergency, or other unforeseen circumstances. In such cases, a replacement session or refund will be provided at Garden Project Academy's discretion, at no additional cost to the Client.
6. Right to Refuse or Discontinue Services
Garden Project Academy reserves the right to decline, cancel, or discontinue coaching services at our sole discretion, including but not limited to situations where:
• We determine, in our professional judgment, that coaching services are unlikely to meet the Client's needs or goals;
• The Client's project, site, or circumstances fall outside the scope of what Landscape Design Coaching can appropriately address;
• The Client engages in disrespectful, abusive, or inappropriate conduct toward Garden Project Academy or its representatives.
In the event Garden Project Academy declines or discontinues services prior to a session taking place, a full refund will be issued for that unused session. In the event services are discontinued after one or more sessions have taken place within a package, a prorated refund for unused sessions will be issued at Garden Project Academy's discretion.
7. Refund Policy
Single Sessions:
• Single session purchases are non-refundable once the session has taken place.
• If you cancel with at least 24 hours notice before a single session, a refund may be considered at Garden Project Academy's sole discretion. Please contact us to discuss your situation.
• If you cancel with less than 24 hours notice or do not attend your scheduled session, no refund will be issued. See Section 5, "Cancellation, Rescheduling, and No-Show Policy," for full details.
Coaching Packages (Multiple Sessions):
• Refund requests for coaching packages are handled on a case-by-case basis at the sole discretion of Garden Project Academy.
• To request a refund on a package, please contact us in writing at the email provided at time of purchase and describe your circumstances.
• Sessions that have already taken place within a package are generally non-refundable. Any refund issued for a package will account for the full value of sessions already used.
Garden Project Academy reserves the right to approve or decline any refund request. Approved refunds will be processed to the original payment method within a reasonable timeframe.
8. Intellectual Property and Ownership
All content, materials, resources, frameworks, documents, worksheets, handouts, and educational materials provided by Garden Project Academy as part of the coaching services are the sole and exclusive intellectual property of Garden Project Academy. This includes all session recordings and transcripts.
As a Client, you agree to the following:
• You may use materials provided to you for your own personal, non-commercial landscape project only.
• You may not copy, reproduce, distribute, share, publish, sell, sublicense, or otherwise make available any materials, resources, session recordings, or transcripts from your coaching sessions to any third party, in any format, without the prior written consent of Garden Project Academy.
• You may not use any materials from your coaching sessions to teach, train, or coach others, whether for compensation or otherwise.
• Unauthorized sharing or distribution of coaching materials, recordings, or transcripts is a violation of these Terms and may result in legal action.
Testimonials and Content Use:
• Garden Project Academy may request your permission to use excerpts of session recordings, transcripts, written feedback, or testimonials for marketing, social media, or website content.
• Your permission will always be sought in writing before any such content is used publicly.
• You may decline any request to use your content, and doing so will not affect your access to or the quality of coaching services.
9. No Guarantee of Results
Landscape design outcomes depend on many factors outside the control of Garden Project Academy, including but not limited to your site conditions, local climate, soil quality, budget, the quality of contractors you hire, and the work you put into applying what you learn. Garden Project Academy makes no guarantees, representations, or warranties regarding specific results, outcomes, or the success of any landscape project you undertake.
10. Limitation of Liability
To the fullest extent permitted by applicable law, Garden Project Academy and its owner(s), employees, and representatives shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising out of or in connection with your use of the coaching services, including but not limited to:
• Any decisions you make regarding your landscape, garden, or outdoor space based on coaching sessions
• Any work performed by contractors, laborers, or other third parties you hire
• Any costs, losses, or damages resulting from plants, materials, or products you purchase
• Any injury, property damage, or financial loss related to your landscape project
In no event shall Garden Project Academy's total liability to you for any claims arising out of or related to these services exceed the total amount paid by you to Garden Project Academy for the specific service giving rise to the claim.
You acknowledge that you are making your own independent decisions about your property and that Garden Project Academy's role is educational only.
11. Governing Law and Dispute Resolution
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in the State of Washington.
Before initiating any formal dispute process, we encourage you to reach out to us directly so we can work toward a resolution.
12. Modifications to These Terms
Garden Project Academy reserves the right to update or modify these Terms and Conditions at any time. Updated terms will be posted on our website and will apply to any services purchased after the date of posting. Continued use of our services following any update constitutes your acceptance of the revised terms.
13. Entire Agreement
These Terms and Conditions constitute the entire agreement between you and Garden Project Academy with respect to Landscape Design Coaching services and supersede any prior communications, representations, or agreements, whether written or oral.
